Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of the ArboristCrew website located at arboristcrew.net (the “Site”), operated by ArboristCrew (“ArboristCrew,” “we,” “us,” or “our”). By using the Site or submitting a request through it, you agree to these Terms. If you do not agree, please do not use the Site.

1. What ArboristCrew Is

ArboristCrew is a local marketing and referral service. We connect San Bernardino County property owners with independent, third-party tree care contractors who are licensed and insured to perform tree removal, trimming, stump grinding, and related services.

ArboristCrew does not perform tree care work. We do not employ arborists, tree crews, or field technicians, and we are not a licensed contractor. Every job is performed exclusively by the independent contractor assigned to your request. That contractor — not ArboristCrew — is responsible for the work performed, any permits required, the quality and safety of the job, and any workmanship warranty offered. Contracts, invoices, and warranties for the work itself are between you and the contractor.

Before any work begins, you are responsible for confirming the assigned contractor’s current license status and insurance coverage. We encourage you to do this even where we’ve indicated a contractor meets our network standards, as license and insurance status can change.

2. Requesting an Estimate

When you submit a quote request through our Site (by form, phone, or chat), you authorize ArboristCrew and/or a matched contractor to contact you about your request using the phone number, email address, or other contact details you provide. This may include calls, texts, or emails, including from an automatic telephone dialing system, even if your number is on a Do Not Call list. Consent to be contacted is not a condition of purchasing any service, and you may revoke it at any time by contacting us at hello@arboristcrew.net or by following the opt-out instructions in any message you receive.

Submitting a request does not obligate you to hire any contractor, and does not obligate ArboristCrew or any contractor to provide services. Estimates are provided at the discretion of the contractor and are not guaranteed to be free of charge unless explicitly stated.

3. Acceptable Use

You agree not to: (a) submit false, misleading, or fraudulent information through our forms; (b) use the Site for any unlawful purpose; (c) attempt to interfere with, disrupt, or gain unauthorized access to the Site or its underlying systems; or (d) scrape, copy, or republish content from the Site without our written permission.

4. Intellectual Property

The Site’s text, design, graphics, and other content (excluding third-party trademarks and content owned by our contractor partners) are owned by ArboristCrew or its licensors and are protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works from this content without our prior written consent.

5. Third-Party Links and Content

The Site may link to third-party websites or reference third-party businesses (including contractor partners) that we do not control. We are not responsible for the content, accuracy, or practices of any third-party site or business, and inclusion of a link or reference does not imply our endorsement.

6. Disclaimer of Warranties

The Site and any information on it are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure, or that any contractor matched through the Site will meet your expectations. Any tree care work performed is subject to the terms and any warranty offered directly by the performing contractor, not by ArboristCrew.

7. Limitation of Liability

To the fullest extent permitted by law, ArboristCrew and its owners, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of property, revenue, or data, arising from your use of the Site or any service performed by a contractor referred through the Site — including damages related to the contractor’s workmanship, licensing, insurance status, or conduct. Your sole remedy for any dispute regarding tree care work is against the performing contractor directly.

Where applicable law does not allow the exclusion or limitation of certain damages, the above limitation applies only to the extent permitted by law.

8. Indemnification

You agree to indemnify and hold harmless ArboristCrew from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your misuse of the Site, your violation of these Terms, or your dealings with any contractor referred through the Site.

9. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of laws principles. Any dispute arising from these Terms or your use of the Site will be subject to the exclusive jurisdiction of the state and federal courts located in San Bernardino County, California.

10. Changes to These Terms

We may update these Terms from time to time. Changes take effect when posted to this page, with the “Last updated” date revised accordingly. Your continued use of the Site after a change is posted constitutes acceptance of the updated Terms.
